6.   The Winery will use its best endeavours to crush the Customer’s fruit at soon as is practicable after delivery unless the Customer by written instruction advises otherwise. Where fruit from more than one Customer has been delivered but not crushed then the Winery shall decide the order in which such fruit will be crushed. The Customer acknowledges that during vintage there may be times when fruit is delivered at times otherwise than is scheduled and this may cause delay in crushing the Customer’s fruit. The Winery accepts no responsibility for any deterioration in the quality of wine that may be caused from such delay in crushing notwithstanding that the Winery will make every effort to minimize any delays.

7.   The Customer is responsible for the harvesting of the Customer’s fruit, whether by machine or by hand picking.  The Customer shall arrange his picking teams or machine harvesting contractor.  All harvesting and transport costs shall be paid by the Customer.  The Winery is not responsible for deterioration of grapes due to a delay in delivery based on errors or delays in harvesting or delivery, or for any cause.

8.   The Customer is at all times responsible for the condition of the Customer’s grapes as delivered to the Winery.  The Winery shall not be responsible for damage to grapes during transport to the Winery or for grapes delivered in poor condition (whether as the result of vineyard management practices, harvesting or transport practices or by disease, spray residue, applied chemicals, pests, or any other cause).  The Customer warrants to the Winery that the Customer’s grapes delivered to the Winery shall contain not more than five (5%) material other than grapes (MOG) and that there are no chemical residues above the international maximum residue limits permitted by law. The Customer acknowledges that excessive MOG, in particular but not limited to leaves, petioles and canes may have a detrimental effect on wine quality.

9.   The Customer acknowledges that the Winery is not responsible for examining or testing the Customer’s grapes but will, if required, and for the applicable fee, undertake grape or bunch sampling prior to harvest. The Customer is responsible for deciding the appropriate picking date for their grapes. The Winery shall not be responsible for reduced wine quality related to the Customer’s grapes not having the required level of ripeness or being over ripe. The Customer shall deliver grapes with in the baume range of 10-12.5 degrees for sparkling base, 11-13.5 degrees for white wines and 12-14.5 degrees for red wines. The Customer acknowledges that grapes delivered outside this range may not produce commercial wines or they may be difficult to ferment to the customers specificaions. The Customer shall not deliver grapes which are affected by disease, spray residue, applied chemicals, pests, or otherwise or contain material other than grapes greater than 5%.  The Winery shall have the right to reject or discontinue processing all or any of the Customer’s grapes or wine for technical (winemaking) reasons or if for any reason the quality of the grapes is in the opinion of the Winemaker not likely to produce a commercially acceptable wine. In the event that the Winery rejects or discontinues processing pursuant to this condition then the Customer is responsible for the removal of the subject grapes or wine within seven (7) days of being so notified by the Winery. If the Customer fails to do so within that time then the Winery may dispose of the subject grapes or wine as it sees fit.

10.   The Winery will weigh every delivery of grapes using the Winery’s scales and such weight shall be accepted as the weight of grapes actually delivered for the purpose of calculating the Customer’s charge for processing.

11.   The Winery will receive wine from a Customer made at another winery for further processing or storage provided that the Customer submits, prior to delivery, two 750ml bottles of such wine to the Winery for analysis by a mutually acceptable independent laboratory and preparation of tasting notes by an independent expert at the Customer’s expense.  The Winery will not receive wine pursuant to this condition where it considers the analysis or the tasting notes to be unsatisfactory. Further the Winery shall have the right to reject or discontinue processing wine at any time where it discovers that the wine is materially different to the analysis or tasting notes provided to it. In that event the Customer is responsible for the removal of such wine within seven (7) days of being so notified and upon failure to do so the Winery may dispose of such wine as it sees fit.

12.   The Customer acknowledges that during the winemaking process there will be inevitable reduction in the volume of their wine as work is performed. Such reduction may be in the range of 10-20% of the volume that is obtained from the first pressing. The Winery will use its best endeavours to keep the reduction to a minimum. The volume of finished wine ready for bottling will depend on the variety of grape, level of ripeness, condition of the grapes when delivered, the length of time spent in barrel  and the requested style of wine produced. The Customer should expect that the final volume may be in the range of 600 to 650 litres per tonne of fruit delivered although the Winery may achieve a better or a poorer result.
